1. Acceptance of Terms

By accessing or using RankYourApp ("Platform"), available at rankyourapp.com, you ("User", "you", or "your") agree to be legally bound by these Terms of Service ("Terms"), our Privacy Policy, and any other guidelines posted on the Platform.

If you do not agree with any part of these Terms, you must stop using the Platform immediately. These Terms constitute a legally binding agreement between you and Cappelli Trading Inc., a company based in Miami, Florida, USA ("we", "us", or "our").

2. About RankYourApp

RankYourApp is an online directory platform where developers, founders, and companies can list and discover software applications. We offer both free and paid services to help app creators increase their visibility.

We act solely as a directory and marketing platform. We do not develop, own, operate, or endorse any third-party application listed on the Platform.

3. Eligibility

You must be at least 18 years old and legally capable of entering into a binding contract to use the Platform or purchase any paid service. By using the Platform, you confirm you meet these requirements.

If you submit a listing or purchase services on behalf of a company or legal entity, you represent that you have the authority to bind that entity to these Terms.

4. App Listings

Users may submit their applications for inclusion in the RankYourApp directory. By submitting a listing, you represent and warrant that:

  • You are the owner or an authorized representative of the listed application.
  • All information provided is accurate, complete, and not misleading.
  • Your application does not violate any applicable laws or third-party rights.
  • Your listing does not contain content that is harmful, offensive, or inappropriate.

We reserve the right to accept, reject, edit, or remove any listing at our sole discretion, including listings that violate these Terms or that we deem inconsistent with the quality and integrity of the Platform.

Listing Updates & Removals: You may request the update or removal of your listing at any time by contacting us at info@cappellitrading.com. We will process your request within a reasonable timeframe. Note that the removal of a paid listing does not automatically entitle you to a refund.

5. Paid Services

RankYourApp offers the following paid services:

Premium Listing: An enhanced directory listing with additional visibility benefits. We expressly reserve the right to modify, add, or remove the specific features included in the Premium Listing at any time, at our sole discretion and without prior notice. The fundamental benefit of increased visibility will be maintained, but individual features may evolve as the Platform develops.

Homepage App Promotion: Featured placement of your application on the RankYourApp homepage for increased exposure. Duration and placement details will be specified at the time of purchase.

Guest Posting (Blog): Publication of a sponsored article or guest post on the RankYourApp blog. All content is subject to our editorial review and must comply with our content guidelines. We reserve the right to decline, request edits to, or remove any blog content that does not meet our standards.

The scope, duration, and inclusions of each paid service are described on the relevant purchase pages at the time of purchase. By completing a purchase, you confirm you have read and understood the description of the service.

6. Pricing & Payments

All prices are displayed in US Dollars (USD) unless otherwise stated. The price applicable to your purchase is the price displayed on the Platform at the moment of your purchase, and that is the price you will be charged.

Price Modifications: We reserve the right to change the prices of any of our services at any time and at our sole discretion, without prior notice. Price changes will not affect purchases that have already been completed and confirmed. We encourage you to review current pricing before completing any purchase.

Payments are processed through authorized third-party payment processors. By submitting payment, you authorize us to charge the applicable fees. You are responsible for any taxes or additional charges imposed by your jurisdiction. We do not store full payment card details on our servers.

7. Refund Policy

Due to the digital and immediately deliverable nature of our services, all sales are generally final and non-refundable once a service has been activated or delivered. This applies to Premium Listings that have gone live, Homepage Promotions that have commenced, and Guest Posts that have been published or approved.

In exceptional circumstances — such as cases where a service was not delivered as described due to our error — we may, at our sole discretion, evaluate refund or credit requests. To submit a refund request, contact us at info@cappellitrading.com within 7 days of your purchase. All decisions are final.

8. User Content

By submitting content to RankYourApp — including app descriptions, logos, screenshots, metadata, and blog content — you grant us a non-exclusive, worldwide, royalty-free, sublicensable license to use, reproduce, display, and distribute that content for the purposes of operating and promoting the Platform.

You retain ownership of your content. You are solely responsible for ensuring it does not infringe any third-party intellectual property rights, violate any privacy laws, or contain false or misleading information.

We reserve the right to remove any content that violates these Terms, without prior notice.

9. Prohibited Conduct

You agree not to use the Platform to:

  • Submit false, misleading, or fraudulent listing information.
  • Infringe upon the intellectual property rights of any third party.
  • Upload or distribute malware, viruses, or any harmful code.
  • Attempt to gain unauthorized access to our systems or other users' accounts.
  • Engage in any activity that disrupts or interferes with the Platform's operation.
  • Use automated tools (scrapers, bots, crawlers) without our prior written consent.
  • Violate any applicable local, national, or international law or regulation.

Violation of these prohibitions may result in immediate termination of your access and, where appropriate, legal action.

10. Intellectual Property

All content on RankYourApp that is not submitted by users — including the Platform's design, logo, code, copy, and structure — is the exclusive property of Cappelli Trading Inc. and protected by applicable intellectual property laws.

You may not reproduce, distribute, modify, or create derivative works from our proprietary content without our express written permission.

11. Third-Party Links & Applications

The Platform may contain links to third-party websites or reference third-party applications. These are provided for informational purposes only. We have no control over and assume no responsibility for the content, privacy policies, or practices of any third-party site or application. Accessing third-party links is done at your own risk.

12. Disclaimers

The Platform and all its content are provided on an "as is" and "as available" basis without warranties of any kind, either express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or free of viruses or other harmful components.

We make no representations about the accuracy, completeness, or reliability of any listing information, as this is provided by third-party users.

13. Limitation of Liability

To the fullest extent permitted by applicable law, Cappelli Trading Inc. and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of, or inability to use, the Platform or its services — even if we have been advised of the possibility of such damages.

Our total cumulative liability to you for any claims arising under these Terms shall not exceed the total amount you paid to us in the 90 days preceding the claim.

14. Termination

We reserve the right to suspend or permanently terminate your access to the Platform at our sole discretion, with or without notice, if we believe you have violated these Terms or engaged in conduct harmful to the Platform, other users, or third parties.

Upon termination, all rights granted to you under these Terms will immediately cease. Provisions that by their nature should survive termination — including intellectual property rights, disclaimers, and limitations of liability — shall survive.

15. Changes to These Terms

We reserve the right to update or modify these Terms at any time. When we do, we will update the "Last Updated" date at the top of this page. For material changes, we will make reasonable efforts to notify users through the Platform.

Your continued use of RankYourApp after any changes take effect constitutes your acceptance of the revised Terms. We encourage you to review these Terms periodically.

16. Governing Law & Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of the State of Florida, USA, without regard to its conflict of law provisions.

Any disputes arising out of or relating to these Terms or your use of the Platform shall be resolved through good-faith negotiation first. If a resolution cannot be reached, disputes shall be subject to the exclusive jurisdiction of the courts located in Miami-Dade County, Florida.
